Terms of service
Last updated: 25 October 2026
These terms of service ("Terms") are the contract between you and PDB CREATIVE DATA SYSTEMS S.R.L., registered office in Oradea, Bihor County, Romania, tax ID (CUI) 49804830 ("we", "Qwirl"), for using the Qwirl service at qwirl.io. By creating an account you accept the Terms. Anyone who only scans a QR code accepts section 12.
1. Definitions
- Service: the website, the app, the scan pages and everything Qwirl offers.
- User (or "you"): a person with a Qwirl account.
- Visitor: a person who scans a QR code made with Qwirl, without needing an account.
- QR code: the code a user creates, with its scan link (like qwirl.io/qr/…).
- Item: what can come up on a scan: a text, a link, an image or a video.
- Prize: a special item with its own chance of winning and a limited number available (section 7).
- No win screen: the optional screen shown to scans that tried for a prize and didn't win.
2. The service
Qwirl lets you create QR codes whose scan page shows, on each scan, the content you choose: items picked at random or always the same item, live streams from connected YouTube or Twitch accounts, and prizes.
The service is currently free. Your account's plan sets the limits: how many QR codes can be active at the same time, how many items one code can have and how much image storage you get. Your plan's limits are shown in Account. We can change them, with notice in advance (section 16).
3. Your account
- You must be at least 16 years old.
- Use a real email address that you control. Addresses with "+" can't be used for new accounts, and addresses that reach the same inbox (for example Gmail variants with dots) count as the same account.
- Keep your sign-in details safe. You're responsible for everything that happens in your account.
- An account belongs to a single person or organization. Don't use several accounts to get around limits or a suspension.
4. QR codes and scan links
- Every QR code has a permanent scan link. The link doesn't change when you change the content, so printed codes keep working.
- A code that's switched off, disabled by an admin or belongs to a suspended account shows an "unavailable" page. A code in review shows "being reviewed".
- Deleting a QR code is permanent: its link stops working and printed codes can't be used any more. Deleting can't be undone.
- You can protect a code with a password. Visitors enter the password once and the code stays unlocked for 12 hours on that device. Changing the password locks everyone out again.
- You can export one code or all of them to a file and import them back. Importing creates new codes, switched off, with new links; plan limits and content rules apply just as when creating them by hand.
5. How a scan picks what to show
This section describes exactly how the choice works, so you know what to expect and can explain it to your visitors.
The order on every scan
- If one of the connected channels (with "show the live stream while live" on) is live, the scan shows the stream. If several channels are live, the first one in the list wins.
- The scan first tries for a prize (section 7).
- If no prize is won, the scan shows the No win screen (if it's on and there are prizes that can be won) or an item chosen as below.
Random result on
- Only items that are active, inside their schedule (if they have one), aren't prizes and aren't in review or removed take part.
- First a rarity tier (Common, Rare or Legendary) is picked, using the odds set in the code's settings, in percent. The default is 70% common, 25% rare, 5% legendary.
- Tiers with no item available are skipped, and the others' odds grow proportionally. Example: with 70% common, 25% rare, 5% legendary and no rare items, common becomes 70/75 ≈ 93.3% and legendary 5/75 ≈ 6.7%.
- Then an item from that tier is picked by weight. An item with weight 3 comes up three times as often as one with weight 1 in the same tier. Weight 0 never comes up.
- A connected channel that adds videos counts as one candidate, with the rarity and weight you choose; when it's picked, one of its recent videos is shown.
- The percentages shown in the app are each item's mathematical probability on one scan, calculated from the odds and weights.
Random result off
- Every scan shows the default item you chose or, if you haven't chosen one, the oldest active item. Visitors can step through the other active items with Previous and Next, in the order of the list.
About chance
- The choice uses a cryptographic random number generator. Every scan is independent of the ones before.
- Odds describe proportions over a large number of scans. Over a small number of scans, results can differ a lot from the percentages: a 5% legendary item can come up twice in a row, or not at all in 50 scans. We don't guarantee any particular distribution in any particular period.
- Schedule: an item with a start and/or end time only takes part inside that window, as if it were switched off outside it.
6. Your content and the content rules
You're responsible for everything your QR codes show or link to: texts, links, images, videos, prizes and the No win screen. Content must not:
- be sexual or adult;
- incite hatred, harass, threaten, be violent or otherwise offensive;
- be a scam, phishing, harmful software or deceive people in other ways (for example fake prizes or requests for bank details);
- break the law or someone else's rights (copyright, trademarks, privacy, image rights);
- be spam or misleading advertising.
Links must be full, secure addresses (https). Links to dangerous domains are blocked. A link is shown to visitors for 5 seconds before it opens, so they can see where they're going.
Your content stays yours. You give us a non-exclusive, free permission, for as long as the content is in Qwirl, to store it, process it technically (for example resizing images) and show it on your scan pages, as far as needed to provide the service.
7. Prizes
Prizes are special items with their own chance. They do not take part in the rarity and weight choice in section 5.
How each scan tries for a prize
- A visitor who has already won a prize on this code today sees the same prize again; reloading the page isn't a new try. "Today" is decided by the daily irreversible visitor code (see the Privacy policy), which changes every day.
- One try every 2 hours, one win per code: a visitor who tried for a prize on this code less than 2 hours ago, or who has already won on it, doesn't try; their scan shows the code's items and doesn't count toward an "every Nth scan" prize. A visitor is recognised by a cookie for that code and, within the same day, by the daily visitor code (see the Privacy policy). After a win, the same device doesn't try for a prize on any of the same owner's codes for 12 hours (recognised by the 12-hour visitor code, see the Privacy policy). Someone who deletes their cookies or uses another device or browser can try again; we don't guarantee that a visitor can't win more than once.
- Turns come first: an "every Nth scan" prize whose turn it is, or a "spread over a period" prize that's waiting, is won (the first one in the list that still has some left).
- Otherwise there's one draw among the percentage and happy-hour prizes. Their chances add up: with one prize at 5% and one at 10%, 15% of scans win something. If together they come to more than 100%, they share 100% proportionally.
- A scan wins at most one prize. Prizes that are switched off, outside their schedule or have none left don't take part.
The four ways to win
- A percentage of scans: every scan has the set chance (for example 5%, about 1 in 20).
- Every Nth scan: the scan that brings the prize's count to each Nth number wins (for example the 50th, the 100th). The count goes up on every scan in which the prize takes part, but each device counts at most once every 12 hours.
- Spread over a period: the prizes are released evenly between the start and the end (the first at the start, then one every period divided by the number of prizes). The next scan after a release wins the released prize. Prizes not won wait for the next scans.
- Happy hours: a normal chance and a higher chance on the chosen days and times, in the user's time zone shown in the editor. A window that runs past midnight (for example 22:00–02:00) belongs to the day it starts.
Prizes and codes
- A prize has either a number of winners or the user's own codes (one per winner, up to 1000). Each code goes to one person only, even if many visitors scan at the same moment. When none are left, the prize stops.
- Codes won stay won. The user can change unused codes; codes already given aren't replaced.
- Copying or exporting a QR code doesn't copy codes already won. Exported unused codes are copied, not moved: if both QR codes are active, the same code can be won twice, and that is the user's responsibility.
- The validity shown on the prize screen (until a date or a number of days after winning) is set by the user.
The user is the organizer
If you use Qwirl for a contest, raffle, promotional campaign or any kind of prize giveaway, you are the organizer and solely responsible for:
- the campaign's official rules and publishing them, where the law requires it;
- the existence, delivery and quality of the prizes, and honoring the codes;
- tax obligations related to the prizes;
- complying with laws on consumer protection, gambling and promotional campaigns (for example free participation), as well as the rules of the platforms used (YouTube, Twitch);
- the right to give out the codes you enter (for example a sponsor's discount codes).
Qwirl is only the technical tool that shows prizes according to the rules above. We don't organize, sponsor or guarantee users' campaigns and aren't responsible for prizes. Qwirl doesn't collect winners' contact details.
8. Live streams and videos
Connecting YouTube uses YouTube API Services: you also agree to the YouTube Terms of Service and the Google Privacy Policy. Videos and streams are played by YouTube and Twitch and follow their rules. Only connect channels that you own or have the right to use.
Live status is checked every few minutes and on scans, so a stream can appear or disappear with a short delay. We're not responsible for YouTube or Twitch being unavailable.
9. Images and storage
- Uploaded images (for items, prizes, logos and the No win screen) are kept in your library and count toward your plan's storage. When the storage is full, uploading stops.
- One image can be used in several places; it counts only once. An image in use must be detached first before it can be deleted.
- Images are private: visitors only see them through temporary links, on the scan pages of active codes.
10. Stats
For each code you see scans per day, unique visitors, what was shown, rarities, prizes won and No win screens. Unique visitors are counted without keeping IP addresses (see the Privacy policy). Stats are indicative and we don't guarantee they're completely exact (for example with robots or repeated scans).
11. Moderation, reports, strikes and appeals
- Content is checked automatically when it's saved and, if the admin has turned on AI checks, also by outside moderation services. A flagged code goes to review: it stays active, but scans show "being reviewed" until a person decides.
- Content rejected by an admin is removed and counts as a strike. Rejecting the whole code also disables it.
- Anyone can report a QR code from its scan page. Each report from a different person counts as a strike, unless an admin dismisses it.
- 3 strikes in 90 days disable the code automatically. We tell you by email.
- You can appeal from the code's page. An accepted appeal re-enables the code and resets its strikes. You get the answer by email.
- We can disable a code or suspend an account immediately for serious or repeated violations, or when the law requires it. When possible, we explain why.
12. For visitors
- You don't need an account or an app to scan.
- The content and prizes on a scan page belong to the user who created the QR code. For any question about a prize or a campaign, contact the organizer.
- If a code shows content that breaks the rules, use the Report link on the scan page.
13. Forbidden use
You may not:
- try to get around limits, anti-robot checks, passwords or moderation;
- automate scans to win prizes or inflate stats;
- overload, attack, scrape or disrupt the service;
- use Qwirl to send people to content forbidden in section 6;
- resell the service or offer it to others under another name without our written consent.
14. Intellectual property
The Qwirl software, name, logo and design belong to us. We don't transfer any rights in them to you beyond using the Service under these Terms.
15. Availability and liability
- We do our best to keep Qwirl running at all times, but we can't guarantee it will have no interruptions, for example for maintenance or because of providers. We can change features; we tell you about important changes.
- The Service is provided "as is". As far as the law allows, we're not liable for indirect losses, lost profits or loss of data, and our total liability is limited to EUR 100.
- You're liable to us for third-party claims caused by your content, your prize campaigns or your breach of these Terms.
- Nothing in the Terms limits liability that the law doesn't allow to be limited, nor your rights as a consumer.
16. Ending and changes
- You can delete your account at any time from Account. Deleting is permanent: QR codes, items, prizes, images, stats and connected accounts are deleted, and printed codes stop working. You can download all your codes to a file first.
- We can close accounts that break the Terms; when possible, we tell you beforehand and explain why.
- We tell you by email about important changes to the Terms at least 30 days before they apply. If you keep using Qwirl after that, you accept the new Terms. If you don't agree, you can delete your account.
17. Applicable law and disputes
The Terms are governed by Romanian law. Disputes are settled by the competent courts in Oradea, Romania, without affecting your rights as a consumer: as a consumer you can also go to the court where you live, and the law of the country you live in still protects you. As a consumer, you can also contact the Romanian consumer protection authority, the Autoritatea Națională pentru Protecția Consumatorilor (ANPC), anpc.ro, including through its alternative dispute resolution (ADR) procedures, or the EU online dispute resolution platform.
